Maggi noodle maker Nestle India has filed a petition at the Bombay High Court on Thursday challenging the food safety regulator's ban on its product that contributes 15 to 20 percent to its revenues.
The case will come up for hearing on 12 June.
In its regulatory filing to the Bombay Stock Exchange (BSE), Nestle India said: "As part of the efforts to resolve the Maggi noodles issue, Nestle India has today approached the Bombay High Court raising issues of interpretation of the Food Safety and Standards Act 2011 while seeking a judicial review of the order dated June 6, 2015, passed by the Food and Drug Administration (FDA) in Maharashtra and the order dated June 5 passed by FSSAI."
Nestle India said that it is continuing withdrawal of Maggi noodles (from the market) and will act according to the Court's order.
"At the same time, we are continuing the withdrawal of Maggi products. This action (moving the court) will not interfere with this (withdrawal) process. We shall proceed further as per the orders that may be passed by the Hon'ble Bombay High Court," IANS quoted Nestle India as saying in the filing.
The Food Safety and Standards Authority of India(FSSAI) had earlier this month ordered pull out of all stocks of Maggi instant noodles from markets across India in view of test reports showing higher than permissible limit of lead and monosodium glutamate (MSG) present in the product.
The Nestle India scrip was trading at Rs 6,043.95 on the Bombay Stock Exchange on Thursday at about 1.40 pm, down Rs 12.90 from its previous close.
"At the same time, we are continuing the withdrawal of Maggi products. This action (moving the court) will not interfere with this (withdrawal) process. We shall proceed further as per the orders that may be passed by the Hon'ble Bombay High Court," Nestle India further added.
