The Law Commission on Monday recommended abolition of death penalty in a phased-manner, except for terrorism-related offences.
In a draft report, the commission has said that the death penalty is constitutionally unsustainable and pointed out that only 59 countries including India award death penalty in courts.
Chaired by Justice (Retd) AP Shah, the Law Commission comprises retired judges Justice SN Kapoor and Justice Usha Mehra as well as Mool Chand Sharma as the other members.
The draft report comes after the Supreme Court had asked the commission to submit a report on death penalty.
