After hearing OnePlus' reply to Micromax's litigation, the Delhi High Court has reportedly lifted the ban on sale of One in India.
On 16 December, a single Bench Delhi High Court had suspended OnePlus One sales in India over Micromax-Cyanogen exclusive agreements.
Micromax had argued that the 'ambient services and application distributions agreement' with the American software company had given the Indian firm the exclusive rights to incorporate CyanogenMod OS in its devices sold in India.
However, multi-judge Delhi High Court Bench headed by Justice Pradeep Nandrajog, after hearing OnePlus' defense counsel, has set aside last week's sales ban order citing that there was a need for more debate on the issue and humorously accused the software firm- Cyanogen as the 'villain' behind this case.
The Bench also added that OnePlus One would not hurt Micromax's YU Yureka sales as they fall in different price-range.
"In view of the facts noted by us hereinabove, it would not be a case to grant an ad-interim injunction, for the reason we were informed that mobile devices launched in India by Micromax are sold at around Rs 8,000 per piece and that by OnePlus at around Rs 22,000 per piece. The consumer of one product is mid-segment and of the other is high-end and thus prima-facie neither competes nor eats into territory of other.
"We dispose of the appeal setting aside the impugned order dated December 16, 2014, simultaneously restoring with a direction that within two weeks from today reply to application as also the written statement shall be filed not only by OnePlus but even by Cyanogen...," PTI quoted court order.
With the sales ban revoked, Indians can now head to Amazon India, provided, they have invites to be eligible to buy the OnePlus One [HERE].
It has to be noted OnePlus One sold in India via Amazon will not get future CyanogenMod OS update. However, there is no reason for anxiousness among fans as the company has already set up an in-house software team to bring out the new community version of Android 5.0 Lollipop OS update to the OnePlus One phones in India later this month.
