Samsung Galaxy S3 will be launched in the US on June 21 despite Apple's best efforts to prevent it.
Apple effort to get a court order to block the Galaxy S3 launch on June 21 was turned down by US District Judge Lucy Koh in San Jose, California, on the ground that it would overload her calendar.
The decision was clearly based on Koh's court schedule. The judge is presiding over another Apple suit against other Samsung products.
Though Apple can appeal against the court's decision, yet the delay in moving its case through the courts will help its opponent, according to Reuters.
"The stalemate is much more of a victory for the accused infringers than it is for Apple," said Stanford Law School professor Brian Love, who is an expert in patent litigation.
